NOW,THEREFORE, in consideration of the mutual benefits passing to and from Owner <br /> and those who may hereafter acquire title to all or any part of the Property, Owner and the Town <br /> agree as follows: <br /> 1. Prohibited Uses. Retail establishments and drive-ups are prohibited on the <br /> Property. Billboard signs are prohibited on the portions of the Property zoned C-2 Commercial <br /> District. <br /> 2. Allowed Uses. Ownership and use of the Property shall be limited to the <br /> following uses: <br /> (a) Major repairs to motor vehicles; <br /> (b) Parking and storing motor vehicles; <br /> (c) Warehouses; <br /> (d) Mini-warehouses; <br /> (e) Banks, offices, buildings and condominium office buildings devoting not <br /> more than two(2) floors to office space; <br /> (f) Woodworking shop,machine shop,manufacturing and assembly plants; <br /> (g) Rental businesses, excluding the rental of motor vehicles and construction <br /> machinery and equipment; <br /> (h) Distribution centers and wholesale businesses; <br /> (i) Warehousing and storage incidental to a use of the Property allowed by <br /> this Deed Restriction; <br /> (j) General mechanical and landscape contracting businesses and building <br /> used in connection with such activities; <br /> (k) Storage of construction equipment necessary for the operation of a <br /> general,mechanical, or landscaping business. <br /> All uses allowed by this Section 2 of this Deed Restriction shall be conducted inside a <br /> fully-enclosed structure. <br /> 3. Conditional Uses. The following uses of the Property shall be prohibited unless a <br /> permit for such use as a conditional use is issued pursuant to the procedures and standards in <br /> place to grant such conditional use permits under the applicable zoning code: <br /> (a) Residence for a watchman or caretaker; <br /> (b) Communication towers; <br /> (c) Government uses; <br /> (d) Agricultural uses. <br /> 4. Lot 10. In addition to the uses allowed in Section 2 of this Deed Restriction or <br /> any other recorded restrictions, Lot 10 of the Property may only be used for a single-family <br /> residence for a watchman or caretaker. <br />
