NOW,THEREFORE, in consideration of the mutual benefits passing to and from Owner and those who may hereafter acquire title to all or any part of the Property, Owner and the Town agree as follows: 1. Prohibited Uses. Retail establishments and drive-ups are prohibited on the Property. Billboard signs are prohibited on the portions of the Property zoned C-2 Commercial District. 2. Allowed Uses. Ownership and use of the Property shall be limited to the following uses: (a) Major repairs to motor vehicles; (b) Parking and storing motor vehicles; (c) Warehouses; (d) Mini-warehouses; (e) Banks, offices, buildings and condominium office buildings devoting not more than two(2) floors to office space; (f) Woodworking shop,machine shop,manufacturing and assembly plants; (g) Rental businesses, excluding the rental of motor vehicles and construction machinery and equipment; (h) Distribution centers and wholesale businesses; (i) Warehousing and storage incidental to a use of the Property allowed by this Deed Restriction; (j) General mechanical and landscape contracting businesses and building used in connection with such activities; (k) Storage of construction equipment necessary for the operation of a general,mechanical, or landscaping business. All uses allowed by this Section 2 of this Deed Restriction shall be conducted inside a fully-enclosed structure. 3. Conditional Uses. The following uses of the Property shall be prohibited unless a permit for such use as a conditional use is issued pursuant to the procedures and standards in place to grant such conditional use permits under the applicable zoning code: (a) Residence for a watchman or caretaker; (b) Communication towers; (c) Government uses; (d) Agricultural uses. 4. Lot 10. In addition to the uses allowed in Section 2 of this Deed Restriction or any other recorded restrictions, Lot 10 of the Property may only be used for a single-family residence for a watchman or caretaker.
