Developer is the current owner of property in Madison,WI 53718 <br /> the Town of Burke, County of Dane, State of <br /> Wisconsin, more particularly described on Parcel Nos: See attached parcel numbers <br /> Exhibit A attached hereto ("Property"), to be <br /> platted as the plat of Wood Ger Development <br /> (the"Plat"). <br /> B. Association will be responsible for the maintenance, repair, and replacement of <br /> stormwater management improvements and measures (the "Stormwater Management <br /> Measures") located on the Property including portions of Lots 1 and 8, as shown on the <br /> Plat. The Stormwater Management Measures shall conform to the Plat and the <br /> stormwater management plan for the Plat approved by the Dane County Land <br /> Conservation Division (the "Management Plan"). A copy of the approved Management <br /> Plan is on file in the offices of Dane County Land Conservation Division and the Town <br /> of Burke. Developer will be responsible for the initial construction and installation of <br /> such Stormwater Management Measures in the Plat in accordance and conformance with <br /> the Management Plan, the Plat, and a Development Agreement between the Developer <br /> and the Town of even date herewith, and thereafter, Association shall be responsible for <br /> the maintenance, repair, and replacement of the Stormwater Management Measures. <br /> C. The parties desire to enter into and to record this Agreement in order to specify the <br /> obligations of the Association for the maintenance, repair, and replacement of the <br /> Stormwater Management Measures and the Town's rights in the event that the <br /> Association does not fulfill its obligations specified in this Agreement. <br /> NOW, THEREFORE, in consideration of the rights and obligations herein and other good <br /> and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, <br /> Developer,Association, and the Town agree as follows: <br /> 1. Maintenance Repair and Replacement. Upon completion of construction of the <br /> Stormwater Management Measures by Developer, Association, and its successors and <br /> assigns, shall, at Association's sole cost, maintain, repair and replace the.Sdormwater <br /> Management Measures so they remain in good working condition and in order to <br /> �a <br />
