Pages: 12 <br /> WHEREAS, the Subdivider has received conditional THIS SPACE RESERVED FOR RECORDING DATA <br /> approval by the Town of a commercial subdivision in the form of RETURN TO: <br /> final plat known as Wood Ger Development, located along Christopher B.Hughes <br /> Reiner Road and Burke Road in the Town ("Subdivision" or Stafford Rosenbaum LLP <br /> PO Box 1784 <br /> "Plat"); Madison,Wisconsin 53701-1784 <br /> WHEREAS,the signing and recording of the final plat for Parcel Identifin Numbers) <br /> See attached catio list <br /> the Subdivision has been made contingent upon, among other <br /> things, the execution of this Agreement and submittal of all <br /> required documents as provided by this Agreement; and <br /> WHEREAS, the Town seeks to protect the health, safety and general welfare of the <br /> community by requiring the completion of various improvements in the Subdivision and thereby to <br /> limit the harmful effects of substandard subdivisions, including pieuiature subdivision which leaves <br /> property undeveloped and unproductive; and <br /> WHEREAS, the Town's Land Division and Subdivision Code (the "Subdivision <br /> Ordinance")requires that Subdivider install, furnish, and finance improvements at Subdividees sole <br /> expense to serve the Subdivision; and <br /> WHEREAS, the Subdivider now wishes to proceed with the installation of public <br /> improvements to serve the Subdivision;and <br /> WHEREAS, the purpose of this Agreement includes, but is not limited to, the avoidance of <br /> harmful consequences of land development prior to satisfactory completion of improvements, or <br /> prior to the payment of improvement costs; and <br /> WHEREAS, this Agreement is made for the mutual benefit of the Subdivider and the Town <br /> in order that the Town's conditional approval of the Subdivision, the Subdivision Ordinance, and <br /> applicable statutory requirements will be fully complied with; and <br /> WHEREAS, the Town will be injured and damaged in the event of the Subdivider's failure <br /> to fully and completely perform the requirements of this Agreement; and, <br /> • <br />
