As work progresses on the installation of Improvements constructed <br /> as part of this Agreement, the Town Clerk/Treasurer, upon written request from the <br /> Subdivider is authorized to recommend one reduction in the amount of surety as <br /> hereinafter provided. When a significant portion of construction of the <br /> Improvements (street, storm water or other improvements) is completed by the <br /> Subdivider, and determined acceptable by the Town Engineer, the Town <br /> Clerk/Treasurer is authorized, upon submission of lien waivers by the Subdivider's <br /> contractors, to reduce the amount of surety in an amount approved by the Town <br /> Engineer. <br /> 3. Upon acceptance by the Town of the Improvements constructed as <br /> part of this Agreement, the Town agrees to reduce the surety to an amount which <br /> does not exceed fifteen percent (15%) of the cost of the Improvements, as estimated <br /> by the Town Engineer, to secure performance of the guarantee described in this <br /> Agreement. <br /> 4. Subdivider agrees to provide written notice of the expiration of any <br /> letter of credit (or replacement letter of credit) provided for herein not less than <br /> forty-five(45)days nor more than sixty(60) days prior to its expiration,by sending <br /> notice to the following address: <br /> Town Clerk/Treasurer <br /> Town of Burke <br /> 5365 Reiner Road <br /> Madison,Wisconsin 53718 <br /> N. Subdivider's Designated Project Manager. The Subdivider hereby appoints <br /> Gerald G.Wood as the Project Manager. Said individual shall act as the Subdivider's representative <br /> during the construction phase of the installation of these Improvements. The Project Manager shall <br /> be available during construction hours on the job site or available by telephone at 608-695-3421. <br /> During non-construction hours, the Project Manager shall be available for emergency situations at <br /> the following telephone number. 608-695-3421. The mailing address for this construction project <br /> shall be as follows: 3370 Burke Road, Sun Prairie,Wisconsin 53590. <br /> 0. Survey Monuments. Subdivider agrees to install all survey monuments for the <br /> final plat in the manner required by law and Subdivision Ordinance. <br /> P. Prevailing Wages. Pursuant to Wis. Stat. § 66.0903, the Town will apply to the <br /> State of Wisconsin Department of Workforce Development (DWD) to determine the prevailing <br /> wage rate for each trade or occupation required to construct the Improvements. Once the <br /> Department issues its determination of the prevailing wage rates (the "Determination"), it shall be <br /> considered to be incorporated into and made a part of this Agreement, and attached as an <br /> attachment. The Subdivider agrees to comply with Wis. Stat. § 66.0903, as well as the following: <br /> (1)The Determination shall be physically incorporated into and made a part of any contract or <br /> subcontract that the Subdivider or its contractor enters into to perform work necessary to construct <br /> 6 <br />
