DANE COUNTY ORDINANCE AMENDMENT NO. 7380 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Westport. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Westport be amended to include in the RH-2 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 7380 <br /> A portion of the SE 1/4 of the NW 1/4 and also part of the SW 1/4 of the NE 1/4 all in <br /> Section 5 South, Town of Westport described as follows: Commencing at the North <br /> quarter corner of said Section 5 South; thence S89°40'05" East, 1108.79 feet; thence <br /> S31°52'15" West, 2431.87 feet to the point of beginning. Thence continuing S31°52'15" <br /> West, 226.17 feet; thence N63°25'11" West, 249.44 feet; thence S21°53'35" West, 29.63 <br /> feet; thence S63°18'46" East, 66.33 feet; thence S21°53'35" West, 100.00 feet; thence <br /> S59°05'20" East, 678.95 feet to a point on a meander line; thence N23°41'44" East along <br /> said meander line 149.86 feet; thence continuing along said meander line N32°37'09" <br /> East, 123.62 feet; thence N50°55'43" West, 499.66 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CER TiFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Required delayed effective date. <br /> 2.The only livestock permitted on the rezone area shall be restricted to horses only. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. i <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
