DANE COUNTY ORDINANCE AMENDMENT NO. 7380 Amending Section 10.03 relating to Zoning Districts in the Town of Westport. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Westport be amended to include in the RH-2 Rural Homes District/s the following described land: PETITION NUMBER: 7380 A portion of the SE 1/4 of the NW 1/4 and also part of the SW 1/4 of the NE 1/4 all in Section 5 South, Town of Westport described as follows: Commencing at the North quarter corner of said Section 5 South; thence S89°40'05" East, 1108.79 feet; thence S31°52'15" West, 2431.87 feet to the point of beginning. Thence continuing S31°52'15" West, 226.17 feet; thence N63°25'11" West, 249.44 feet; thence S21°53'35" West, 29.63 feet; thence S63°18'46" East, 66.33 feet; thence S21°53'35" West, 100.00 feet; thence S59°05'20" East, 678.95 feet to a point on a meander line; thence N23°41'44" East along said meander line 149.86 feet; thence continuing along said meander line N32°37'09" East, 123.62 feet; thence N50°55'43" West, 499.66 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CER TiFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County, a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.Required delayed effective date. 2.The only livestock permitted on the rezone area shall be restricted to horses only. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. A copy of the recorded document shall be submitted to Dane County Zoning. i The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c).
