Request <br /> Fish Lake Development, LLC is requesting the removal of deed restrictions to allow the <br /> company to operate a year-round mobile home park on property in the town of Roxbury. <br /> Currently,the site is limited to summer seasonal use. <br /> B. Location of Property <br /> The property includes 35 acres on the northeast shore of Fish Lake, in the northeast <br /> quarter of Section 3, Town of Roxbury. The parcel has approximately 550' of frontage <br /> on Schoepp Road. The property is currently zoned R-4 and lies entirely within the <br /> County's Shoreland Zoning jurisdiction. <br /> 1 <br /> C. Current Land Use <br /> There are currently between 10 and 15 mobile homes on the property, all served by <br /> private wells and holding tanks. There are no soils on the site that are suitable for on-site <br /> wastewater treatment. <br /> D. History <br /> There were a number of technical irregularities in the rezoning and deed restriction <br /> recording process associated with previous actions on this property. This section <br /> attempts to summarize the relative points. See chronology in files for a detailed <br /> explanation. <br /> Petition# 6083, approved in January of 1995,rezoned 24 acres of the parcel from A-1 <br /> exclusive to R-4 residential. Deed restrictions associated with the rezone imposed three <br /> conditions: 1)the property can be used only as a mobile home park; 2)no more than 100 <br /> mobile homes are permitted, and 3)mobile homes shall be occupied only from April 1 to <br /> November 1 of each year. CUP #1190 was approved in February of 1995,with <br /> conditions limiting the number of mobile homes to 100. <br /> Petition# 6461, approved in April of 1996, rezoned an adjacent 11 acres from A-1 <br /> exclusive to R-4 residential. Deed restrictions limiting use to a mobile home park, <br /> limiting occupancy to summer months and limiting the number of mobile homes to 100 <br /> for the entire 35 acres were also recorded. CUP#1295 was approved in May of 1996, <br /> with conditions that mirrored the deed restrictions. <br /> In December of 1996,the County recorded a condominium plat,"Summer Place on the <br /> Lake,"with 102 units, on the property in question. <br />
