Based on my conversations
with Mr. Lovett, I believe he and Mr. Kearney would find the following conditions of approval,
in addition to the four recommended by the ZNR, acceptable:
5. To the extent practicable, the landowner shall permanently restore a thirty-five (35)foot
wide buffer of perennial natural vegetation along the shore. Such buffer shall be designed to
effectively meet the purposes of section 11.04 (1) of the Dane County Code of Ordinances
within 5 years.
6. Remaining land owned by Fish Lake Development Corporation, including the entire
northwest'quarter of the southwest quarter of Section 2, Town of Roxbury and Parcels
Numbered 18001, 18530 and 19501 in Section 3, Town of Roxbury shall be deed restricted to
non-structural use.
These conditions would address the concerns raised by the County Executive concerning
negative impacts to the water quality, natural scenic beauty and fish and wildlife habitat of Fish
Lake resulting from high density, year-round development along or near the shore.
Please feel free to contact me at 267-4115 if I can be of any further assistance.
Ct
