ANALYSIS OF EFFECT OF CHANGE IN WATER LEVEL OF FISH LAKE <br /> The Zoning Division has evaluated the effect of the new ordinary highwater mark of Fish Lake <br /> on Petition#7287. According to the Department of Natural Resources, the water level of the <br /> lake has risen by 2.24 feet since 1993. The DNR has established the new ordinary highwater <br /> mark elevation for Fish Lake at 859.25 feet above mean sea level, compared with the previous <br /> mark of 856.45. Based on field investigations of the Summer Place on the Lake site, Zoning <br /> Division staff estimate that this change would result in a horizontal loss of between 25 and 40 <br /> feet of shoreland on the east shore of Fish Lake. This means that the depth of the condominium <br /> units along the shore (numbers 1 through 31) has been substantially reduced. <br /> Based on this information, the Zoning Administrator has determined that the mobile homes <br /> currently located on Units 5, 7 and 10 have now become non-conforming structures. Under the <br /> county zoning and shoreland ordinances, such structures are allowed to remain, but cannot be <br /> expanded or improved beyond 50% of their current assessed value and must be brought into <br /> conformity if they are ever substantially damaged. The Zoning Administrator estimates that <br /> approximately six to eight of the vacant condominium units have been so reduced in size that <br /> placing a 76' mobile home and a 12' deck will likely be impossible without violating zoning <br /> setback standards. Detailed studies of individual units will be necessary to determine the <br /> allowable building footprint for each unit. <br /> II. SUGGESTED CONDITIONS OF APPROVAL <br /> In light of the rapidly changing water level of Fish Lake and the potential impact of the proposed <br /> development described in the original staff report for Petition 7110, the committee may wish to <br /> consider adopting the following findings of fact and conditions: <br /> FINDINGS OF FACT: <br /> Regarding Petition # 7287, seeking to remove deed restrictions limiting the use of property in the <br /> Town of Roxbury to a seasonal mobile home park use, the Zoning and Natural Resources <br /> Committee finds the following: <br /> 1. Conversion of the property from seasonal to year-round use represents a significant change <br /> in the intensity of the land use. <br /> 2. Year-round use of the property is likely to lead to more and larger permanent structures, <br /> greater impervious surface area and significant changes in the hydroloy, vegetation and <br /> character of the immediate shore area. <br /> 3. Without additional safeguards, these changes to the character of the immediate shore area <br /> would likely result in degraded water quality, increased risk of erosion and water pollution, <br />
