• <br /> Cont.#7287: <br /> Page 2 <br /> AMENDED DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner <br /> or owners of the land shall record the following amended restrictions on said land: <br /> 1). The above described real estate shall be used only for a recreational mobile home park for <br /> so long as said real estate shall be zoned R-4. <br /> 2). The maximum number of mobile homes allowed to be placed on the above described real <br /> estate shall be limited to 100 for so long as said real estate shall be zoned R-4. <br /> 3) Condominium units 1 through 36 shall be deed restricted with a document acceptable to the <br /> Zoning Administrator and recorded in the Register of Deeds,that notifies condominium or land <br /> owners that the water levels of Fish Lake may continue to rise, and that their structures could <br /> become nonconforming and/or exoerience flooding in the future. <br /> The rezoned area shall be subject to the following conditions. <br /> 1. The submittal of a development plan, dated August 27, 1998, showing the location of the <br /> current ordinary highwater mark of Fish Lake as established by the DNR, and all applicable <br /> zoning setback lines. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the <br /> owners of land within 300 feet of the site. Failure to record the amended restrictions will <br /> cause this amendment to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1Xa),(b),(c). <br />
