• <br /> Authorization To Petition For Amendments To Covenants and Restrictions <br /> ("Authorization") <br /> The undersigned("Owners")own not fewer than 10 lots in the Highway 19 Commercial Plat, <br /> the First Addition To Highway 19 Commercial Plat and the Second Addition To Highway 19 <br /> Commercial Plat,all in the Town of Burke,Dane County, Wisconsin(collectively,the "Commercial <br /> Plat"). The Owners own the lots described in Exhibit A attached hereto. Pursuant to Paragraph 1 <br /> of the Covenants and Restrictions affecting the Commercial Plat, and amendments thereto(as more <br /> specifically described in Exhibit B attached hereto) (collectively, the "Restrictions"), the Owners <br /> hereby direct and authorize Hwy. 19,LLP, by Glenn J. Hovde,to take such steps as are necessary <br /> (including, but not limited to, the filing of an Amendment Petition, as such term is defined in the <br /> Restrictions,with the Dane County Clerk and the execution and recording of an amendment to the <br /> Restrictions pursuant to this Authorization)to amend the Restrictions as follows: <br /> (a) Paragraph 1(b)(iii) shall be amended to read as follows: "rental and leasing of <br /> contractor's machinery and equipment;" and <br /> (b) Paragraph 2(a)(ii)shall be amended to read as follows: "with regard to Lots 4 and 5 <br /> of the Highway 19 Commercial Plat, Lot 10 of the First Addition To Highway 19 <br /> Commercial Plat, and Lots 11 through 16 of the Second Addition To Highway 19 <br /> Commercial Plat, all buildings or other structures shall be not less than 75 feet from <br /> the lot line adjacent to U.S.Interstate Highway 90-94("I90-94"),or, as the case may <br /> be, from the off-ramp from I90-94 to Wisconsin Highway 19 adjacent to the Real <br /> Estate("Off-Ramp");" and <br /> (c) Paragraph 2(a)(iv) shall be amended to read as follows: "with regard to Lots 1 <br /> through 5 of the Highway 19 Commercial Plat, Lot 10 of the First Addition To <br /> Highway 19 Commercial Plat, and Lots 11 through 16 of the Second Addition To <br /> Highway 19 Commercial Plat,vehicle parking lots or areas shall be not less than 20 <br /> feet from the lot lines adjacent to I90-94,the Off-Ramp or Wisconsin Highway 19, <br /> as the case may be;". <br /> Dated this 22nd day of July, 1998. <br /> HWY. 19, LLP EVERGREEN I, LLC <br /> By: BY <br /> Glenn J. ova e David Server <br /> Authorized Partner Authorized Member <br /> ::ODMA\WORLDOX\F\EAFDATA\1 200132711 kBLH0937.WP D-7/22/98 <br />
