2499071 <br /> • <br /> • AMENDMENT TO COVENANTS AND RESTRICTIONS <br /> WHEREAS, Hwy. 19 Joint Venture, a Wisconsin joint venture (hereinafter, the <br /> "Developer"), is the developer of certain real estate described in Exhibit A attached hereto (the <br /> "Real Estate"); and <br /> WHEREAS, the Developer has caused to be recorded certain conditions, covenants, <br /> reservations and restrictions (collectively, the "Covenants")with regard to the Real Estate, said <br /> Covenants having been recorded with the Dane County Register of Deeds on October 15, 1991, <br /> in Volume 16920 of Records, page 9, as Document Number 2295529- and3 7 6 P 56 <br /> WHEREAS, the Developer is presently the owner of not fewer than ten (10) Lots, as <br /> such term is defined in the Covenants; and <br /> WHEREAS, the Developer desires to amend the Covenants as herein provided, all <br /> pursuant to Paragraph 3(b) of the Covenants. <br /> NOW,THEREFORE,the Developer hereby amends the Covenants as herein provided. <br /> 1. The third recital on page 1 of the Covenants is hereby stricken and replaced with <br /> the following: <br /> "WHEREAS,the Developer intends to subdivide the Real Estate into not <br /> fewer than thirteen (13) lots, including outlots (collectively, the "Lots" and, <br /> individually, a "Lot"), which initial subdivision shall be known as the "Burke <br /> Highway 19 Commercial Plat",with subsequent additions thereto(collectively, the <br /> "Plat"); and" <br /> 2. The following is hereby added as clause (xii)to Paragraph 2(e)of the Covenants: <br /> "(xii) all site developments will be required to maintain groundwater <br /> recharge to the greatest extent possible, with a minimum requirement that all <br /> parking lot runoff be infiltrated." <br /> IN WITNESS WHEREOF, Hwy. 19 Joint Venture has caused its duly authorized joint o <br /> venturers to execute this Amendment to Covenants and Restrictions this 2/ "day of July, <br /> 1993. <br /> HWY. 19 JOINT VENTURE <br /> Glen s• l e, Joint Venturer <br /> / <br /> NV <br /> Ronald E.
