DANE COUNTY ORDINANCE AMENDMENT NO. 7360 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Burke be amended to include in the C-2 Commercial District's the <br /> following described land: <br /> PETITION NUMBER: 7360 <br /> Land in the NW 1/4 Section 5, Town of Burke described as follows: Lots 3, 4, 6, and 7 <br /> of Highway 19 Commerical Plat. Lots 8, 9, and 10 of First Addition to Highway 19 <br /> Commercial Plat. Lots 11-16 of Second Addition to Higwhay 19 Commercial Plat. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3Xa) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REOUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following lust ictions on said land: <br /> (a)All uses permitted in the C-1 Commercial District without limitations as to size. <br /> (b)Major repairs to motor vehicles. <br /> (c)Sales of new and used motor vehicles. <br /> (d) Sales of new and used mobile homes,recreational equipment rental,sales and service. <br /> (g)Rental and leasing of motor vehicles. <br /> (j) Auxiliary or supplemental electric generating stations. <br /> (m)Bottling plants. <br /> (n)Utility services. <br /> (s)Warehouses. <br /> (t)Games such as horseshoes,volleyball or similar activities not lighted for night operation. <br /> (u)Mini-warehouses. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> tAf.\\°5 <br /> k(RO,Q.. <br /> The D.ne County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
