DANE COUNTY ORDINANCE AMENDMENT NO. 7366 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Dunn. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Dunn be amended to include in the R-1A Residential Districtls the <br /> following described land: <br /> PETITION NUMBER: 7366 <br /> Part of the NE 1/4 of the NE 1/4 of Section 16, Town of Dunn described as follows: <br /> Commencing at the Northeast corner of said Section 16; thence South along the East Line <br /> of the NE 1/4, 100 feet more or less to the point of beginning; thence continue South, 90 <br /> feet more or less, thence West, 360 feet more or less; thence North, 150 feet more or less; <br /> thence East along South right-of-way line of Mahoney Road, 265 feet more or less; thence <br /> Southeasterly, 115 feet more or less to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> ALSO: <br /> TO R-1A: <br /> A part of the NE 1/4 of the NE 1/4 of Section 16, Town of Dunn, described as follows: <br /> Commencing at the Northeast corner of said Section 16; thence West along the North line of <br /> the Northeast quarter, 380.00 feet to the point of beginning;thence continue West, 200.00 feet; <br /> thence South, 300.00 feet; thence East, 200.00 feet; thence North, 300.00 feet to the point of <br /> beginning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Remaining 37.6 acres in parcel#0610-161-8000 restricted from further residential development. <br /> 2.That the residential structures shall have separate wells. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,t' .._ <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
