DEED RESTRICTION <br /> PAGE 3 <br /> III. NOW, THEREFORE, in consideration of the mutual benefits passing to <br /> and from the owner and those who may hereafter purchase said land <br /> and the parties named as beneficiaries of these restrictions, the <br /> following restrictions are hereby imposed: <br /> 1 . The C-2 parcel shall be deed restricted to limit use of the <br /> property to the following: major repairs to motor vehicles, sales <br /> of new and used motor vehicles and parking or storage of motor <br /> vehicles . The existing apartment on this site shall be abandoned <br /> or converted to a permitted use unless a Conditional Use Permit <br /> for a residence for a caretaker or watchman is approved by the <br /> County. <br /> 2 . Prior to the issuance of any zoning permits on the property, <br /> all junk and inoperable vehicles, as defined in Section <br /> 10. 01 (28) of the Zoning Ordinance shall be removed or stored in <br /> an enclosed structure to comply with Section 10 .20 of the Zoning <br /> Ordinance, or a license to operate a salvage recycling center <br /> shall be successfully obtained from the Zoning Administrator. <br /> 3 . Prior to the issuance of any zoning permits on the property, a <br /> sanitary system inspection for all buildings intended or used for <br /> human occupation shall be performed by a qualified plumber or <br /> private onsite sewage treatment system inspector. Failing or <br /> inadequate septic systems noted in the report shall be either <br /> repaired or replaced to meet all current requirements of the <br /> state plumbing code and the Dane County Sanitary Ordinance. <br /> 4 . Prior to approval of the Certified Survey Map for the proposed <br /> 12-acre RH-3 lot identified as Lot 1 on the preliminary CSM, a <br /> certified soil test showing adequate soils for a private onsite <br /> wastewater treatment system and shall be submitted to the Plat <br /> Review Officer. The Plat Review Officer shall take into <br /> account the suitability of soils for building construction and <br /> septic installation when determining the suitability of the land <br /> for development. <br /> These restrictions shall constitute covenants running with the land <br /> and shall be binding upon all parties now owning any part of said <br /> land, their successors, heirs and assigns, and all parties holding <br /> under them unless, pursuant to paragraphs 5 or 6 of this <br /> instrument, said restrictions are amended or terminated. <br />
