DANE COUNTY ORDINANCE AMENDMENT NO. 7335 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of York. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of York be amended to include in RH-1 and RH-2 Rural Homes the <br /> following described land: <br /> PETITION NUMBER: 7335 <br /> Part of the the S 1/2 of the SE 1/4 of Section 8, Town of York described as follows: <br /> TO RH-1: Commencing at the Southeast corner of said Section 8; thence N89°08'26" <br /> West, along the South line of said SE 1/4, 1356.26 feet to the point of beginning; thence <br /> continuing N89°08'26' West, along said South line, 420.00 feet; thence N00°09'06"East, <br /> 245.00 feet; thence S89°08'26"East, 420.00 feet; thence S00°09'06"West, 245.00 feet <br /> to the point of beginning. <br /> Part of the S 1/2 of the SE 1/4 of Section 8, Town of York described as follows: <br /> TO RH-2: Commencing at the Southeast corner of said Section 8; thence N89°08'26" <br /> West, along the South line of said SE 1/4, 1176.26 feet to the point of beginning; thence <br /> continuing N89°08'26"West, along said Sout hline, 180.00 feet; thence N00°09'06"East, <br /> 245.00 feet; thence N89°0'26"West, 420.00 feet; thence N00°09'05"East 391.00 feet; <br /> thence S89°08'26"East, 600.00 feet;thence S00°09'06"West, 636.00 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.No further development on parcels 0912-084-9000 and 0912-084-9500. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the ow <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to • • 'u and <br /> void. <br /> "I9,\rd■_ <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
