DANE COUNTY ORDINANCE AMENDMENT NO. 7341 ' <br /> • <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Cottage Grove. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Cottage Grove be amended to include in the RH-1 Rural Homes and <br /> A-2 Agricultural Districts the following described land: <br /> PETITION NUMBER: 7341 <br /> TO RH-1: <br /> Part of the SE 1/4 and the NE 1/4 of the NW 1/4 of Section 7, Town of Cottage Grove <br /> described as follows: Commencing at the West quarter corner of said Section 7; thence <br /> along the South line of the said Northwest quarter, N85°15' East, 2099.2 feet to the East <br /> line of the said Northwest quarter; thence along said East line, North, 960.00 feet to the <br /> point of beginning; thence continuing along said East line North, 450.00 feet to the South <br /> right-of-way line of CTH BB; thence along said South right-of-way line, S79°45' West, <br /> 240.00 feet; thence South, 410.00 feet; thence East, 240.00 feet to the East line of the said <br /> NW 1/4 and the point of beginning. <br /> TO A-2: <br /> Part of the SE 1/4 and the NE 1/4 of the NW 1/4 of Section 7, Town of Cottage Grove <br /> described as follows: Commencing at the West quarter corner of said Section 7, thence <br /> along the South line of the said Northwest quarter, N85°15' East, 1422.7 feet to the point <br /> of beginning; thence continuing along said South line N85°15' East, 676.5 feet to the East <br /> line of the said Northwest quarter, thence along said East line North, 960.00 feet; thence <br /> West, 240.00 feet; thence North, 410.00 feet to the South line of County Highway BB; <br /> thence along said South right-of-way line S79°45' West, 440.00 feet; thence South, <br /> 1333.27 feet to the South line of the said Northwest quarter and the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.That there shall be no residential development on the A-2 rezone area. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their ;tobe <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b), ). <br />
