DANE COUNTY ORDINANCE AMENDMENT NO. 7321 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Black Earth. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Black Earth be amended to include in the A-2 Agricultural District/s <br /> the following described land: <br /> PETITION NUMBER: 7321 <br /> Part of the E 1/2 SW 1/4 and W 1/2 SE 1/4 Section 36, Town of Black Earth described as <br /> follows: Lot #4, CSM #8967 found in Volume 50, Page 96, of Certified Survey Maps <br /> Dane County Register of Deeds office. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner <br /> or owners of the land shall record the following restrictions on said land: <br /> 1). That there be no further residential development on parcels 8-06-362-9501, 8-06-361- <br /> 8700, 8-06-363-8001, 8-06-361-9000, 8-06-364-8501, 8-06-364-8001. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the <br /> owners of land within 300 feet of the site. Failure to record the restrictions will cause the <br /> rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The rezoned area shall be subject to the following conditions. <br /> 1. The buildable area of Lot 1 shall be limited to an area 250 feet from the centerline of County Highway <br /> "KP" and east of the west line of Lot 3 extended. <br /> 2.The buildable area of Lot A shall be entirely within the SE1/4 of the SW 1/4 of Section 36. <br /> 3. All of the lots will have one common access point from County Highway"KP". <br /> 4.Lots 1, 2, 3 which have frontage on County Highway"KP" will not be allowed to use that frontage for <br /> access but will be required to use the shared access drive. <br /> 5.The rezoned area shall be developed in a manner consistent with the above conditions and the attached <br /> development plan labeled Exhibit A and dated 11/18/97. <br /> o ( P <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1Xa),(b),(c). <br />
