COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> 29. 7321 Raphael and Betty Ripp(Bernie Harrop, agent-realtor),Black Earth 36 <br /> Amend Deed Restrictions of previous Petition#6974 and rezone remaining parcel of less than 35 <br /> acres from A-1EX to A-2 <br /> Petit"n 6974 created(3)RH-2 parcels and(3)RH-3 parcels totaling 72+-acres. It was approved by <br /> NR Comm. 02/17/1998 with the following Conditions: <br /> 1. the Zoning and Natural Resources Committee-adopted model"Private Road Agreement"shall be <br /> utilized <br /> 2. The buildable area of Lot 1 shall be limited to an area 250 feet from the centerline of County <br /> Highway"K?'and east of the west line of Lot 3 extended. <br /> 3. The buildable area of Lot A shall be entirely within the SE1/4 of the SW1/4 of Section 36. <br /> 4. All of the lots will have one common access point from County Highway"KP". <br /> 5. Lots 1,2,3 which have frontage on County Highway"KP"will not be allowed to use that frontage <br /> fo* access but will be required to use the shared access drive. <br /> 6. Access Point shall be located directly across"KP"from Ripp driveway. <br /> 7. The rezoned area shall be developed in a manner consistent with the above conditions and the <br /> attached development plan labeled Exhibit A and dated 11/18/97. <br /> 8. An"easement and maintenance agreement"for the shared access drive shall be executed and <br /> recorded with the Dane County Register of Deeds, and a copy of such recorded document shall be <br /> provided to the Zoning Administrator. <br /> This document was recorded 07/08/1998,along with CSM's 8967& 8968. However,the <br /> CSM's show a Town road--Page Lane--which functions as access to all the lots in lieu of the private <br /> road and easements described in the above Restrictions. So the Ripps now wish to remove restrictions <br /> #1. and#8., above,which no longer apply. (Please note that the Deed Restrictions recorded do not <br /> include#1., above, and are <br /> renumbered 1-7.) <br /> The Ripp's are also requesting rezoning of a"remainder"parcel of 19.313 acres to A-2. <br /> When Petition 6974 was filed for the 07/22/1997 ZNR P.H.,this remainder would have been a legal <br /> part of the Ripp's remaining 190 acre farm. But on 05/01/1998,the land division requirement for a <br /> CSM was changed from 15 acres to 35 acres, so the 19 acres became Lot 4 of CSM 8967, and <br /> consequently must be rezoned for zoning compliance. <br /> Lot 4, CSM 8967 to A-2 only: <br /> Soils: 60%Class I-II, 35%Class III, 5%Class IV <br /> Use: 100%Crops <br /> REGIONAL PLANNING <br /> Petition 7321. This development area was approved with conditions particularly for an easement. <br /> However,through the Certified Survey Map process, a new town road has been dedicated which <br /> provides access to these lots, and the requirement of an easement is no longer necessary. <br /> ENVIRONMENTAL HEALTH (seatic, etc.) <br /> DANE COUNTY HIGHWAY <br /> Petition 7321. CTH "KP" is not a controlled access highway. Any new access to be from local road. <br /> OTHER <br />
