COMPOSITE REPORT- Petition No.7321 <br /> ZNR Work Meeting 9/25/98 Town Black Earth <br /> II. ANALYSIS <br /> A. The original farm was 345 acres at the time of Town Plan Approval. According to <br /> the 35 acre formula it was entitled to 9.8 splits. By rounding up the number, it <br /> would be a total of 10 splits. Three splits were used previously to build three <br /> houses in the southeast of the property and 6 splits were used with petition 6974. <br /> From the count of splits, a piece of land sold to the WisDNR and a previous CSM <br /> never built upon were excluded. The proposed rezone uses the last split <br /> available for all lands which were part of the Raphael Ripp original farm. <br /> / \\ •►'` R. The shared driveway proposed in the previous petition is now being proposed as a <br /> town road. The owners are requesting to amend the conditions that the committee <br /> had put on the previous petition and that were referring to the driveway. Those <br /> conditions were numbered 1 and 8 in the approved rezone and were numbered as <br /> condition 7 in the deed that was filed (condition 1 on utilizing a ZNR adopted <br /> "Private Road Agreement"was not filed in the deed). Condition 7 filed in the <br /> deed is no longer applicable. <br /> III.SUMMARY <br /> A. The proposal to rezone to A-2 would use the last split available on the property. <br /> In this case, it would be advisable to "deed restrict"the remainder of the farm (approx. <br /> 168 acres, north of hwy 14) so prospective buyers are informed about its "non- <br /> buildable" status. <br /> B. It makes sense to amend the deed restriction filed to delete condition 7 that refers <br /> to the shared driveway as it does not apply any longer due to the replacement of the <br /> driveway with a town road. <br />
