COMPOSITE REPORT - Page 2 APPLICATION NO.
STAFF COMMENTS
ZONING REVIEW
20. 7312 Jacob Niesen(Stephen Nording,agent-attorney), Cross Plains 11
A-1EXtoR-1A
Divide a 3.12 acre NC'g A-1EX parcel into two 1.56 acre SFR lots. One lot will be used for a
Community Living Arrangement residence"for less than nine(9)adults transitioning back to the
community from traumatic brain injury related accidents;"this facility would be built by October 1,
1998. The other lot"may be used as a residence for the applicant's children."
Note that there were two previous attempts to rezone this property, both unsuccessful:
• Pet 5898 to C-2 for landscape contractor/garden center business was vetoed by Co.Exec. in 1994;
• Pet 6200 to A-B and LC-1 for landscape contractor/garden business center was vetoed by Co.
Exec. in 1995.
Note:An intermittent stream tributary to Black Earth Creek flows E to W along the N'ly boundary of
the R 1A lots, and the SW corner of the rezone area lies within 300' of Black Earth Creek and may to
be encroached upon by its associated Floodplain.
REGIONAL PLANNING
Petition 7312. This proposed residential division is in an Agricultural Preservation District of the
Town of Cross Plains. The relevant adopted town/county policy is:
"Lands in the agricultural district should not be rezoned for non farm residential
development at an overall density of greater than one dwelling per 35 acres owned as of the
date of adoption of this plan.,"
With a parcel of 3.1 acres, dividing it into two parcels conflicts with the adopted policy. If such
divisions are desired by the town, the town/county plan should be amended, either by changing the
policy or changing the map to specify what form and density of development is intended.
ENVIRONMENTAL HEALTH (septic, etc.)
DANE COUNTY HIGHWAY
OTHER
