DANE COUNTY ORDINANCE AMENDMENT NO. 7312 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Cross Plains. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Cross Plains be amended to include in the R-1A Residential <br /> District/s the following described land: <br /> PETITION NUMBER: 7312 <br /> A parcel of land being part of Lot #1, CSM#3898, located in the SE 1/4 of the NE 1/4 of <br /> Section 11, Town of Cross Plains. Start at the Southwest corner of said Lot #1, thence <br /> N00°19'38"West, along the Westerly line of said Lot #1, 180.68 feet; thence N73°57'30" <br /> West, 347.71 feet; thence S73°06'40" East, 254.51 feet; thence S08°11'57" West, 221.51 <br /> feet; thence N88°16'52" West, along the North right-of-way of Stagecoach Road; 545.31 <br /> feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description's is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REOUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.That there shall be no further division of the rezone area. <br /> 2.Lot 1,as shown on page 2 building location survey dated 5/28/98,permitted use for community living <br /> arrangements is restricted to community living arrangements for 3 or fewer persons. <br /> 3.Lot 2,as shown on page 2 building location survey dated 5/28/98,permitted uses are restricted to single <br /> family dwellings,home occupations and uses and buildings clearly incidental and necessary to permit use <br /> on the premises. <br /> Said restriction shall run in favor of Dane County and the pertinent To; :oard as •ell as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions ause the rezone to be null and <br /> void. Cik <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
