DANE COUNTY ORDINANCE AMENDMENT NO. 7318 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Berry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Berry be amended to include in the RH-2 and RH-4 Rural Homes, <br /> and A-2(8) and A-2(4) Agriculture Districts the following described land:. <br /> PETITION NUMBER: 7318 <br /> TO RH-4: <br /> A part of the NE 1/4 NW 1/4 of Section 30, Town of Berry, described as follows: <br /> Beginning at the North quarter corner of said Section 30; thence South, 1615 feet; thence <br /> S69 West, 400 feet; thence West 277 feet; thence South, 449 feet; thence S73°30' West, <br /> 69 feet along the centerline of Kahl Road; thence North, 470 feet; thence N50°20' West, <br /> 294 feet; thence North, 863 feet; thence West, 368 feet; thence North, 720 feet; thence <br /> East, 1320 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3Xa) 2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner <br /> or owners of the land shall record the following restrictions on said land: <br /> 1). There shall be no further land division of RH-4 zoning parcel. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the <br /> owners of land within 300 feet of the site. Failure to record the restrictions will cause the <br /> rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> TO RH-2: <br /> A part of the NE 1/4 NW 1/4 of Section 30, Town of Berry, described as follows: <br /> Commencing at the North quarter corner of said Section 30; thence West, 1320 feet; <br /> thence South, 720 feet to the point of beginning; thence South, 600 feet; thence East, 368 <br /> feet; thence North, 600 feet; thence West, 368 feet to the point of beginning. <br /> TO A-2(8): <br /> A part of the NE 1/4 NW 1/4 and the SE 1/4 NW 1/4 of Section 30, Town of Berry <br /> described as follows: Commencing at the North quarter corner of said Section 30; thence <br /> West, 1320 feet; thence South, 1320 feet to the point of beginning; thence South, 1104 <br /> feet; thence N73°30' East, 456.3 feet along the centerline of Kahl Road; thence North, <br /> 223.5 feet; thence N73°30' East, 163.2 feet; thence North, 246.3 feet; thence N50°20' <br /> West, 294 feet; thence North, 263 feet; thence West, 368 feet to the point of beginning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1Xa),(b),(c). <br />
