DANE COUNTY ORDINANCE AMENDMENT NO. 7158 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of York. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of York be amended to include in the RH-1 Rural Homes and C-2 <br /> Commercial District/s the following described land: <br /> PETITION NUMBER: 7158 <br /> C-2: <br /> Part of Lot 1, Certified Survey Map Number 7835, being part of the Northwest 1/4 of the <br /> Northeast 1/4 of Section 15, Town of York, described as follows: <br /> Commencing at the North 1/4 corner of said Section 15; thence N87°42'02"E, along the <br /> North line of said Northeast 1/4, 221.95 feet; thence S02°17'58"E, 33.00 feet to the point <br /> of beginning, said point being on the South right-of-way of Muller Road; thence <br /> N87°42'02"E, along said South right-of-way, 180.00 feet; thence S02°17'58"E, 147.00 <br /> feet; thence S87°42'02"W, 180.00 feet; thence NO2°17'58"W, 147.00 feet to the point of <br /> beginning. <br /> RH-1: <br /> Part of Lot 1, Certified Survey Map Number 7835, being part of the Northeast 1/4 of the <br /> Northwest 1/4 and part of the Northwest 1/4 of the Northeast 1/4 of Section 15, Town of <br /> York, described as follows: <br /> Commencing at the North 1/4 corner of said Section 15; thence S02°34'35"W, 33.14 feet <br /> to the Northwest corner of Lot 1 said Certified Survey Map Number 7835, said point <br /> being on the South right-of-way of Muller Road and the point of beginning; thence <br /> N87°18'07"E, along said South right-of-way, 2.93 feet; thence N87°42'02"E, along said <br /> South right-of-way, 221.84 feet; thence S02°17'58"E, 147.00 feet; thence N87°42'02"E, <br /> 180.00 feet; thence NO2°17'58"W, 147.00 feet; thence N87°42'02"E, along said South <br /> right-of-way, 428.18 feet; thence S03°48'14"W, 230.45 feet; thence S87°42'02"W, <br /> 828.00 feet; thence NO2°34'35"E, 229.96 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. To limit the uses in the C-1 Zoning District to item(o)only and the C-2 uses shall be limited to item <br /> (d)excluding the sale of new and used mobile homes. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> v / z--2- ' 8 <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c). <br />
