COMMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 7158. This proposed commercial rezoning in the Town of York raises some policy <br /> concerns with the adopted town/county polices. <br /> The existing RH-2 parcel has an existing farmstead (house, barn, and outbuildings) in an <br /> agricultural preservation area. <br /> The currently adopted town/county objective and policies are: <br /> "Commercial-Industrial Development <br /> Objective: The objective of the Town of York is to facilitate commercial and <br /> industrial development which fosters and enhances the growth of agricultural <br /> activities and enterprise within the Town. <br /> Policies: To accomplish its objective with respect to commercial and industrial <br /> development, the policies of the Town will be: <br /> 1. To allow such commercial and industrial development as is needed to <br /> support existing agricultural activities where it will not result in <br /> environmental degradation or conflict with farming operations. <br /> 2. To limit rezoning to that portion of land which is necessary for the <br /> commercial or industrial use contemplated <br /> 3. To avoid any substantial expenditure of public funds and the incurrence of <br /> municipal debt for the construction or provision of municipal <br /> improvements and services usually associated with commercial and <br /> industrial development. <br /> Staff comments related to policies: <br /> The plan objective is clearly pointing to "the growth of agricultural activities." <br /> 1. The application indicates small engine repair and recreational vehicle sales. Small engines <br /> are commonly used in agriculture; however, recreational vehicles are not commonly <br /> considered "agricultural." <br /> One could rationalize all-terrain vehicles and snowmobiles, which are used in some farm <br /> operations. However, these are considered "recreational equipment" in the zoning <br /> ordinance and thus C-2 Commercial zoning is required. <br /> Cry Most of the uses permitted in the C-2 Commercial district would conflict with the adopted <br /> policy.
