r <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 7163 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Rutland be amended to include in the RH-2 Rural Homes Districts <br /> the following described land: <br /> PETITION NUMBER: 7163 <br /> Part of the NE 1/4 of the NW 1/4 of Section 17, Town of Rutland, described as follows: <br /> Beginning at the NW 1/4 corner of Section 17; thence East along the North line of the NE <br /> 1/4 of the NW 1/4 and the centerline of Oak Hill Road, ±1795 feet; thence continue East <br /> along said North line and centerline, 400 feet to the Northwest corner of Certified Survey <br /> Map number 6949; thence South along the West line of said Certified Survey Map, 545 <br /> feet; thence West, 400 feet; thence North, 545 feet to the centerline of aforesaid road and <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.That there shall be no further residential development on parcels 0510-172-8500,0510-172-8050, <br /> 0510-172-8725, 0510-172-9000,0510-172-9560,0510-172-8030, and 0510-172-8010. <br /> Said restriction shall run in favor of Dane County and the pertinent Town_Board as I as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezon to be null and <br /> void. <br /> ("K-41) <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
