DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition #7261 (Seston) Public Hearing Date: 6/23/98 <br /> I. BACKGROUND <br /> A. Request <br /> Lynn Seston is seeking to rezone 2.06 acres from the A-1(ex) Exclusive Agriculture district to <br /> the RH-1 Rural Homes district to separate and sell the existing farmhouse and buildings from the <br /> balance of the farm. <br /> B. History/Past Actions <br /> Petition# 7098, approved by the ZNR on 12/16/97, rezoned 2.4 acres of the Seston property <br /> from A-1(ex)to RH-1. The rezone became effective when CSM#8813 was recorded on 2/5/98. <br /> (See attached map.) <br /> Petiton#7178, approved by the ZNR on 4/28/98, rezoned 11.51 acres of the Seston property <br /> from A-1(ex)to A-2(8). This rezone became effective when CSM#8954 was recorded on <br /> 6/22/98. (See attached map.) This action was necessary to clean up 11.51 acres of land separated <br /> from the rest of the property as a result of CSM #8813. Despite the fact that this would appear to <br /> have been the last remaining split on the property under the town land use plan, no deed <br /> restrictions were imposed. <br /> C. Site/Locational Information <br /> The proposed rezone site is located in the northeast quarter of the southeast quarter of Section 6 <br /> in the Town of Berry. The site is on the southern side of the terminus of Gorst Road, roughly <br /> 1,200 feet west of Old Settler's Road. The proposed new lot would have approximately 140 feet <br /> of frontage onto Gorst Road. The property is in a rural area, approximately 5 miles northeast of <br /> the Village of Mazomanie. The area is characterized by a mix of low-density rural housing, <br /> farms and woodland. There is an existing farmhouse and several agricultural accessory buildings <br /> currently on the site. <br /> D. Other federal, state or county approvals required <br /> A certified survey map and a delayed effective date will be required (a draft CSM has already <br /> been submitted). <br /> II. ANALYSIS <br /> A. Compliance with Adopted Plans <br /> Town Land Use Plan <br /> There is some question as to whether this proposal complies with the Town of Berry Land Use <br /> Plan (adopted in 1981). The property is in an area identified as an agricultural preservation area <br /> in the Town plan, where the following policy applies: <br /> 1 <br />
