PLANNING Y ": ,.. <br /> March 26, 1998 <br /> ZONING DIVISION <br /> Dear Mr. Van Deurzen, <br /> Yesterday I talked with Mr. William Kuhl regarding rezoning petition 7167 in the Town of <br /> Medina which came before your committee this past Tuesday evening. Mr. Kuhl related to me <br /> that your committee found the Town's request to have a deed restriction placed upon the <br /> remainder of his farm to be quite humorous. I am glad to hear that the Town of Medina is able to <br /> make the ZNR Committee laugh regarding what we consider a serious matter. Mr. Kuhl also <br /> indicated to me that it was stated the requested deed restriction was against county policy and/or <br /> illegal. I took over as Chairman for the Town last Spring so I guess I will claim some ignorance <br /> to this matter. I would be pleased if you would write me and explain in detail what the problem <br /> is so I can shed this cloak of ignorance. I would first like to establish what I understand the <br /> situation is so you can determine from where my ignorance stems. <br /> Mr. Kuhl is attempting to sell off a 35.8 acre parcel from his farm and the party purchasing the <br /> property intends to build a house on this parcel. This constitutes what the county establishes as <br /> one site. <br /> Dane County Zoning is requiring Mr. Kuhl to proceed with a rezoning of this parcel in order to <br /> build upon it. <br /> The Town has requested a deed restriction be placed upon the remaining parcels which states <br /> that no other residential construction is allowed without going through a rezoning process. (See <br /> attached letter sent to Dane County Zoning January 31, 1998.) <br /> The committee has indicated to Mr. Kuhl that this is either against county policy and/or illegal <br /> yet it is consistent with what Dane County is requiring to be done on such parcels in order to <br /> build on them. <br />
