COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> Petition 7263 Tyrol Basin Corp.,Vermont 28 & 33 [SEE ALSO#23. 7262] <br /> A-1EX TO RE-1 with CUP with Conditions for ski runs lighted at night <br /> Tyrol Basin Corp has recently purchased 49 acres. 30+-acres of this purchase are already zoned RE-1. <br /> 5+-acres are being rezoned to RH-1 —see Pet. #7262 above. This leaves 14.44 acres, divided into four <br /> separately described areas, all proposed to be zoned to RE-1. "These parcels adjoin and are a part of the <br /> property owned by Tyrol Basin Corp. and [are] used for an alpine ski resort. Rezoning to RE-1 would <br /> reflect actual use and bring all Tyrol Basin property into compliance within appropriate zoning for <br /> recreational use." <br /> Existing CUP# 682, effective 09/27/1988,provided for the sales of alcoholic beverages and the use of <br /> loudspeakers in the B-1 District,and for standards for lighting <br /> the ski slopes in the RE-1 District. Tyrol Basin proposes to extend the CUP for"recreational facilities... <br /> lighted to operate during the hours of darkness"as per Section 10.10(2)(b)of the Zoning Ordinance. <br /> Applicable conditions of CUP#682 include: <br /> 2. In the RE-1 Recreation conditional use permit for the outdoor lighting: <br /> A. The lighting shall be limited to the downhill ski slopes. The lights shall be hooded to cut down <br /> on the light splashing away from the ski slopes. <br /> B. Hours of operation of the downhill lighting shall be limited to 11:30 PM when the facility is <br /> open for recreational purposes. However the lighting may be continued beyond this hour when the <br /> facility is not open to the general public for non-revenue generating activity, eg:team practice. <br /> This use shall be limited to 6 times a year as per review by the Town of Vermont Board. <br /> C. Partial lighting is permitted for maintenance and snowmaking when the ski slopes are otherwise <br /> closed. <br /> Note: Bohn Creek,with associated Floodplain, is located across Bohn Road within 300 feet of the B-1 and <br /> RE-1 portions of Tyrol Basin. <br /> REGIONAL PLANNING <br /> Petition 7263 —CUP 1505. This is a proposed expansion of the Tyrol Basin Ski area in the Town of <br /> Vermont. the adopted town/county plan has the following relevant policy: <br /> "Commercial recreation proposals will be limited to: <br /> • Those uses having minimal impact on the natural environment. <br /> • Uses with access to a state or county highway. If a town road is involved, the applicant must <br /> demonstrate minimal impact to neighbors. If the town road requires improvement, the <br /> applicant will be asked to pay their share of such improvement. <br /> • The size of such a proposal must be limited to protect the rural character and preserve the <br /> natural beauty of the town." <br /> Staff Comments: <br /> • If the use is limited to snow skiing,there should be minimal impact. Any additional earth moving or <br /> construction of facilities will need review for erosion control. <br /> • Access is on Balm Road, which is a narrow, curving town road. CTH JG is approximately 1/4 mile <br /> south,while CTH J is approximately 3/4 mile to the north. <br /> • The addition of 19.39 acres to this complex appears reasonable and is not visible from the road. <br />
