HOREB, WI 53572 <br /> TEL: 608-767-3889 FAX : 608-767-3887 <br /> June 23, 1998 <br /> TO: ZONING & NATURAL RESOURCES COMMITTEE <br /> DANE COUNTY ZONING DIVISION <br /> RE: ZONING PETITION #7263, CUP # 1505 <br /> Please forgive my inability to appear at your hearing to review a Dane <br /> County application for change of zoning from Tyrol Basin Corp. <br /> This short letter is to clarify the position of the Vermont Town Board <br /> with regarding to zoning petition #7263 and CUP #1505. <br /> Unfortunately, the "Town Board Action Report" dated June 18, 1998 and <br /> submitted by our Town Clerk does not accurately reflect a vote of the <br /> Vermont Town Board at our June 8, 1998 meeting. At the June 8th <br /> meeting I made a motion to deny and hold in abeyance Tyrol' s requests <br /> for rezoning and a CUP for parcels of land totaling 19.39 acres as <br /> shown on the notice your June 23 public hearing. This motion was <br /> approved by the Town Board and overrode a previous vote that was taken <br /> at our April 13, 1998 meeting, a vote that our Town Clerk references <br /> in the "Town Board Action Report. " Therefore, I must ask you to not <br /> act on this application at your June 23 hearing. <br /> The reason for the change in the Town Board' s position is that we are <br /> presently in negotiation with Tyrol Basin to establish a covenant that <br /> will serve as a deed restriction on the scope of recreational <br /> activities that can occur on their property without prior Town Board <br /> approval. The June 8th Board action was based on the legal advice we <br /> received in a May 27, 1998 letter from Mr. Mark Hazelbaker who <br /> reviewed our existing Memorandum of Understanding with Tyrol Basin. <br /> While I can not speak for our Town Board, let me conclude by stating <br /> that we anticipate supporting a conditional rezone of the Tyrol <br /> Basin's property once we establish a new Memorandum of Understanding <br /> and covenant governing recreational use of this property. <br /> Bes- egards, <br /> ,ri Thein ro <br /> liCA) 't5M <br />
