NOW, THEREFORE, in considera ion of the mutual benefits passing to <br /> and from the owner and thos: who may hereafter purchase said land <br /> and the parties named as be eficiaries of these restrictions, the <br /> following restrictions are h: reby imposed: <br /> 1 . The petition be amended to rezone Lot 3, as shown on the <br /> preliminary CSM, to the C-i Commercial District. Deed <br /> restrictions shall be imposed limiting the permitted uses to the <br /> following: <br /> a) Retail sales normally associated with a golf clubhouse, but <br /> not including alcoholic b-verages. <br /> b) Storage incidental to a p-rmitted use. <br /> c) Rental business, limited o those normally associated with a <br /> golf clubhouse. <br /> 2 . The A-2 lot designated as Lot 1 on the preliminary CSM shall <br /> be deed restricted to the fallowing uses : <br /> a) Agricultural uses . <br /> b) Utility services. <br /> 3. Prior to the issuance of any zoning permits for operation of <br /> the clubhouse, the landowne ' shall apply for, and obtain, a <br /> conditional use permit from the county to allow for the single <br /> family residence currently an the proposed Lot 3 on the <br /> preliminary CSM. <br /> 4 . The landowner shall co ply with all conditions and <br /> requirements of the erosion control plan approved by the County <br /> Land Conservation Departmen. , the Special Exception Permit <br /> approved by the Board of Ad ustments and any correction orders <br /> issued by the Department of Planning and Development. <br /> 5. The landowner shall co ply with all applicable state and <br /> local regulations, licensin• requirements or laws. <br /> 6. The property shall be developed and maintained in <br /> accordance with the revised site plan dated 5/10/1998 . <br /> 7 . Within the 20 to 50 foot wide area along the navigable <br /> stream, shown on the site p an as a buffer zone, the landowner <br /> shall maintain an undisturb:d buffer of natural shoreline <br /> vegetation to meet the purposes of Section 11 . 04 (1) of the County <br /> Shoreland Ordinance. Mowin. , herbicide and pesticide use shall <br /> be prohibited in this area, except as part of an erosion control <br /> or habitat restoration plan approved by the County Land <br />
