REZONE AND CONDITIONAL USE PERMIT APPLICATIONS FROM PREVIOUS <br /> MEETINGS <br /> a. CONDITIONAL USE PERMIT# 1484 by Curtis A. &Debra D.Herfel to allow mineral <br /> extraction site on property located West of 2005 State Highway 69 in part of the S 1/2 SE 1/4 and NW <br /> 1/4 SE 1/4 Section 28,Town of Verona. <br /> Supervisor Anderson stated that he has no connection with Curtis and Debra Herfel nor does he have any <br /> connection with the lease holder of the land,Fitanburg Minerals.He indicated that he does have a lease <br /> with Payne and Dolan the proposed operators of CUP 1484.He stated that he is paid a fixed amount per <br /> ton as part of the contract.He stipulated that he has fully explained the situation to the Corporation <br /> Counsel who has stated that there is no provision that impedes his ability to vote on this petition. <br /> Therefore he stated that he intends to participate in the debate and cast his vote at the appropriate time. <br /> Mr.Mark Roffers indicated to the committee that the City of Verona has not taken any formal action on <br /> CUP 1484 but they are in the process of changing their plan. City indicated they hold a sanitary easement <br /> but it is no longer in use. <br /> Motion by Anderson/Hamre that the 47 conditions as presented by the applicant be added to the <br /> Conditional Use Permit;carried 6-0. <br /> Main Motion by Cornwell/Kuhn that the Zoning and Natural Resources Committee denies CUP 1484 <br /> because the proposal does not meet the following standard for granting a conditional use permit,found in <br /> S. 10.255(2)(h)of the Dane County Zoning Ordinance: <br /> 1. That the establishment, maintenance,or operation of the conditional use will not be detrimental to or endanger <br /> the public health, safety,comfort or general welfare. <br /> A mineral extraction operation in this location raises the following concerns which could be detrimental to the <br /> public heath,comfort,and general welfare: <br /> • The subject property is located within a sensitive environmental area characterized by high-priority <br /> surface water resources, including the Badger Mill Creek and Sugar River. The entire area is within the <br /> Sugar River watershed,which is the subject of an EPA and DNR sponsored initiative aimed at <br /> identifying innovative ideas for preserving water resources. Further,the Dane County Parks and Open <br /> Space Plan identifies the subject property as part of the proposed Badger Mill Creek resource protection <br /> area. A significant spill of petroleum products on-site could pollute these surface water resources. The <br />
