COMPOSITE REPORT-Page 12 Application No. CUP 1484 <br /> The County Parks and Open Space Plan identifies the subject property as part of a <br /> proposed "Badger Mill Creek"resource protection area. This plan states that the <br /> proposed designation"recommends that the wetlands and adjacent uplands along <br /> Badger Mill Creek be protected from the Badger Prairie Park south to the <br /> confluence of the Sugar River."Allowing a more intensive use on the property <br /> could affect the resource and recreational value of this future resource protection <br /> area. The applicant has offered to donate lands to the County for park and/or <br /> resource protection purposes (see Page 5 of Operators proposed 5/14 conditions). <br /> Parks staff have not yet had the opportunity to consider this offer. <br /> 4. That adequate utilities, access roads, drainage, and other necessary site <br /> improvements will be provided. Proper erosion control techniques will have to be <br /> approved and maintained to ensure that construction site drainage does not impact <br /> surface waters. The operator has submitted a Phase 1 erosion control plan to the <br /> County for approval. There has also been some concern among neighbors that <br /> drainage from the farm to the east would flow into the pond. Map G shows how <br /> the operator intends to divert such drainage both north and south of the pond to the <br /> STH 69 ditches at reclamation. There should be provisions to control against mud <br /> being tracked onto STH 69. <br /> 5. That adequate measures are being taken to provide ingress and egress to minimize <br /> traffic congestion. The operator has agreed to make all road/intersection <br /> improvements recommended by Paulson and Associates, WisDOT staff, and <br /> County staff before any hauling begins. WisDOT reviewed the Paulson plan for <br /> access and on February 9 DOT District 1 staff indicated preliminary acceptance of <br /> those plans with suggestions for additional right-of-way dedication. The Paulson <br /> report mentions the importance of maintaining vision triangles in all directions at <br /> the access road. At Planning staffs suggestion, the applicant has agreed to a 300 <br /> foot acceleration lane for northbound traffic leaving the site--this will be the <br /> predominant traffic movement and will allow trucks to approach the speed of traffic <br /> on STH 69 before merging. The operator has also agreed not to haul through the <br /> City of Verona unless a load was destined for that City. <br /> 6. That the conditional use shall comply with all applicable regulations. The project <br /> as presented must comply with several local, state, and federal regulations on an <br /> ongoing basis. It appears that the operator intends to comply with all regulations. <br /> K. According to S. 10.123(3)(a) of the zoning ordinance, the ZNR Committee must also <br /> consider the following factors when approving CUPs in the A-1 Exclusive District: <br /> 1. The statement of purposes of the zoning ordinance and the A-1 Exclusive <br /> Agriculture District. The purpose of the district, in part, is to preserve productive <br /> agricultural land and preserve productive farms by preventing land use conflicts. <br /> 2. The potential for conflict with agricultural use. See Section II(F)3 above. <br /> 3. The need of the proposed use for a location in an agricultural area. The operator <br /> has presented information related to the large volume of sand and gravel on the site. <br /> The operator also indicates that the location on a state highway and close to the <br />
