DANE COUNTY ORDINANCE AMENDMENT NO. 7218 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Berry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Berry be amended to include in the RH-1 Rural Homes Districts the <br /> following described land: <br /> PETITION NUMBER: 7218 <br /> Part of the SW 1/4 NW 1/4 of Section 17, Town of Berry, described as follows: <br /> To RH-1: Beginning at the Northeast corner of said SW 1/4-NW 1/4; thence South <br /> 570 feet;thence West 200 feet; thence North 570 feet; thence East 200 feet to the point of <br /> beginning. <br /> Part of the SW1/4-NW1/4 of Section 17, Town of Berry, described as follows: <br /> To RH-2: Beginning at the West 1/4 corner of said Section 17; thence North 19°East, <br /> 350 feet; thence North 07° West, 380 feet; thence Northeasterly, 309.25 feet; thence <br /> North 53°26' East, 472.10 feet; thence Easterly, 137 feet; thence East, 97.5 feet; thence <br /> South 05°12' West, 1322 feet; thence West, 720 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REOUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REWIRED <br /> • <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Prohibit further residential development on parcels 0807-172-9001,0807-173-8500,0807-173-9000 <br /> and 0807-173-8000. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as w the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cau rezone to be n', and <br /> void. <br /> \ \'3■Cls <br /> Oro\) \16 <br /> INS <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
