Wood) <br /> Dear Mr. Scribner: <br /> The above-referenced Rezone Petition # 7168 was adopted on May 7, <br /> 1998, with an eighteen month delayed effective date of November 11, 1999. <br /> On October 21, 1999, the delayed effective date was extended by <br /> amendment to April 7, 2000. <br /> On March 2, 2000, the delayed effective date was extended by amendment <br /> to September 2, 2000. <br /> On July 6, 2000, the above-referenced action was commenced in Dane <br /> County Circuit Court. <br /> On May 20, 2003, the Wisconsin Supreme Court issued a Remittitur in the <br /> above-referenced action, effectively ending the litigation. (See copy of Remittitur <br /> attached hereto.) <br /> It is our understanding that the running of the delayed effective date was <br /> tolled by the commencement and pending of the above-referenced litigation. It is <br /> our further understanding that the running of the delayed effective date resumed <br /> upon the date of the Remittitur—on May 20, 2003. <br />
