DANE COUNTY ORDINANCE AMENDMENT NO. 7237 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Middleton. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Middleton be amended to include in the RH-3 Rural Homes <br /> Districts the following described land: <br /> PETITION NUMBER: 7237 <br /> A parcel of land located in the SW 1/4 SE 1/4 Section 27, Town of Middleton, described <br /> as follows: Commencing at the North quarter corner of said Section 27, thence <br /> S03°41'32" East, along the North-south line, 2650.09 feet to the center of said Section <br /> 27; thence continuing along South North quarter line, S03°41'52" East, 2646.77 feet to <br /> the South quarter corner and the point of beginning; thence NO3°32'40" West, 1086.28 <br /> feet; thence N81°51'44" East, 718.01 feet; thence S23°32'26" West, 386.16 feet; thence <br /> S31°36'59" West, 502.65 feet; thence S30°02'26" West, 300.96 feet; thence along the <br /> arc of a curve to the left whose radius is 500.00 feet and whose chord bears S17°02'07" <br /> West, 146.63 feet;thence S84°36'00"west, 32.42 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 9Q days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on Said land: <br /> 1.That the garage is not to be used for human habitation purposes and that the building is not to be used <br /> for business or commercial purposes. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. III <br /> /Vs <br /> 1.\ <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
