Direct access to USH 12-18 shall be prohibited when <br /> reconstruction is not occurring in the portion of the highway project adjacent to the <br /> CUP area. <br /> 12. The safety fence shown on the revised plans shall be a minimum of 5 feet in height. <br /> During operations, the edge(s)of the extraction area shall be maintained at a slope <br /> no greater than 1:1. The site shall be signed"no trespassing." When the extraction <br /> site is not open, the access road onto CTH N shall have gates securely locked. <br /> 13. There shall be no blasting or drilling on the site. <br /> 14. There shall be no bulk fuel stored on the site. <br /> 15. No water shall be removed from the site in order to maintain groundwater discharge <br /> to adjacent areas. <br /> 16. The operator shall use spray bars(water) in the crushing process to reduce dust. <br /> Use of spray bars is not required when the temperature is below freezing. The <br /> operator shall spray the site with water if and when needed to control dust. <br /> 17: The operator shall require all trucks, excavation, crushing, screening and washing <br /> equipment to have muffler systems which meet or exceed then current industry <br /> standards for noise abatement. <br /> 18. If the Highway Commissioner determines that improvements to the intersection of <br /> the access road and CTH N are necessary as a result of the mineral extraction <br /> operation, the operator shall improve such intersection at its expense to the <br /> specifications of the Highway Commissioner. <br /> 19. The applicant shall meet DNR standards for particulate emissions as described in <br /> Nit 415.075,Wis. Adm. code. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND <br /> IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1. That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other <br /> necessary site improvements will be made. <br />
