COMPOSITE REPORT-Page 4 Application No. CUP 1476 <br /> applicant may do some grading (but no extraction)between the CUP area and this fence. <br /> The site plan also shows a screening berm along CTH N, with a staging and scale area <br /> roughly behind it. (The preliminary erosion control plan--provided as Exhibit B--also <br /> shows berms surrounding most of the rest of the site, although these will probably have <br /> little screening benefit.) The proposed access drive is in a location acceptable to the <br /> Highway Department, and the operator has agreed to improve the intersection if <br /> Highway staff deem it necessary in the future. The access drive would be paved to a <br /> distance of 150 feet from CTH N, and the entrance would be gated. <br /> E. Exhibit C provides a"Phase 1" operations plan. The plan shows that Phase 1 <br /> extraction would occur on the northern 20± acres of the site. That area would be <br /> connected to the CTH N entrance and the USH 12-18 project area by a gravel drive. <br /> The location of the connecting drive is somewhat speculative at this point pending a <br /> decision of where the operation will be allowed to access the highway project area. <br /> During the duration of the highway project,the applicant proposes and the Town <br /> supports that primary access be directly from the highway construction site. <br /> F. Exhibit D provides the "Phase 2"operations plan, covering the remaining 37± acres of <br /> the site. The operator proposes to use overburden and topsoil from the Phase 2 area to <br /> reclaim the Phase 1 area. <br /> G. Exhibit E shows the proposed reclamation plan. Reclamation is proposed within one <br /> year following completion of operations. Previously removed topsoil and overfill <br /> would be used to restore the site to agricultural use. The applicant indicates a <br /> willingness to provide a bond for reclamation. <br /> H. The following is a review of this proposal against the six standards for granting a CUP <br /> in S. 10.255(2)(h): �. _ <br /> 1. That the conditional use will not endanger the public health, safety, welfare. This <br /> standard can probably be met. Fencing around the non-highway sides of the project <br /> area will be provided and the CTH N road will be gated to inhibit unwanted access. <br /> The operation will not create significant slopes which could present a safety hazard. <br /> The applicant proposes to stay 400 feet away from the creek with extraction <br /> activities, and will be required to submit and have approved an erosion control plan <br /> to control stormwater runoff. The applicant indicates that no excavation below the <br /> groundwater level is expected. Water used for washing and dust control is <br /> proposed to come from wells or pumped from the creek,but only if DNR permits to <br /> allow such activity are obtained. No all water taken from the site should be <br /> removed from the site. There would be no fuel stored on site, but on-site fueling of <br /> equipment would likely occur. <br /> 2. That uses, values, and enjoyment of other properties in the neighborhood will not <br /> be impaired by the conditional use. Staff believe that this standard will not be met <br /> with the proposal as presented, but can be met if the duration of the project is <br /> reduced and proper conditions are applied and followed. The proposed extraction <br /> operation could have an impact on nearby residences, including the residential <br /> subdivisions to the north. These could include dust, noise,visual, and traffic <br />
