EFFECTIVE NOVEMBER 9, 2015 <br /> Dane County Board of Supervisors <br /> Amending Chapter 10 of the Dane County Code of Ordinances <br /> Zoning Map Amendment Petition 10862 <br /> Dane County Board of Supervisors does ordain as follows: <br /> The Zoning Districts Maps as referenced under Dane County Code of Ordinance Section <br /> 10.03 shall be amended as follows: <br /> Town Map: Town of Burke Location: Section 23 <br /> Zoning District Boundary Changes <br /> A-1 TO C-2 <br /> Part of the Southeast 1/4 of the Southeast 1/4 of Section 23 T8N, R10E,Town of Burke, Dane <br /> County, Wisconsin, more fully described as follows: Commencing at the East 1/4 corner of said <br /> Section 23;Thence S0°53'03"W, along the East line of said Southeast 1/4, 1319.14 feet <br /> (recorded as 1318.78 feet)to the point of beginning Thence continuing S0°53'03"W along said <br /> East line 243.38 feet;Thence S89°4'20"W (recorded as S89°05'04"W), 196.99 feet;Thence <br /> NO0°53'03"E, 110.00 feet;Thence N89°04'20"E (recorded as N89°05'04"E), 18.00 feet; Thence <br /> N00°53'03"E, 133.38 feet;Thence N89°04'20"E (recorded as N89°05'04"E), 178.99 feet to the <br /> point of beginning; Containing 45,485 square feet, or 1.4 acres,gross; and 37,454 square feet, or <br /> 0.85 acres, net; Subject to an easement for highway purposes for Reiner Road over the Easterly <br /> 33.00 feet thereof. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the <br /> owner or owners of the land record the following restriction(s) on said land: <br /> 1. A deed restriction shall be recorded on the property to limit the land uses to a single- <br /> family dwelling and residential accessory buildings. Commercial activities are prohibited. <br /> 2. A deed restriction shall be recorded on the property to prohibit the <br /> construction/erection of off-premise advertising signs (billboards). <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as <br /> well as the owners of land within 300 feet of the site. Failure to record the restriction(s) <br /> will cause the rezone to be null and void. A copy of the recorded document shall be <br /> submitted to Dane County Zoning. <br />
