On March 5, 2015, the Dane County Board approved this map amendment with two conditions. <br /> See attached. The conditions required that is certified survey map be recorded noting the boundary <br /> changes and a deed restriction be placed on the remaining A-1 exclusive zoned property to prohibit <br /> further residential development on the farm. <br /> On April 23, 2015, the Dane County Zoning Division sent a letter to you regarding these required <br /> conditions. The letter notes that you would have until October 17, 2015 to record the certified survey <br /> map and record the deed restriction. As of this date, the deed restriction has not been recorded on the <br /> remaining A-1 Exclusive property. Failure to meet the conditions of approval for zoning petition <br /> DCPREZ-2014-10803 will render the petition null and void. <br /> Given that the time period to record the necessary documents has expired, I am unable to change the <br /> zoning maps as noted under Zoning Petition #10803. Please be aware that the properties listed as Lot <br /> 1 and Lot 2 of Certified Survey Map 14006 recorded under Register of Deeds document#5164650 are <br /> currently in violation of Dane County Code of Ordinance Section 10.123 and Dane County Code of <br /> Ordinance Section 75.19(6)(g). The properties do not meet the area standards for the A-1 Exclusive <br /> Agriculture Zoning District nor do the current property lines coincide with zoning boundary lines. <br /> In order to correct the violation, the deed restriction will need to be recorded within 5 days of the date of <br /> this letter. If the deed restriction is not recorded, zoning petition #10803 will be rendered null and void <br /> and enforcement action will commence on the properties that are in violation of the Dane County Code <br /> of Ordinances. Please note that each day the properties are in violation will constitute a separate <br /> offense. <br /> If would appreciate your cooperation in this matter.
