COMPOSITE REPORT - CUP No. 1483 <br /> Public Hearing 03/24/98 Town of Westport <br /> 1. ANALYSIS <br /> A. Portion of the Property Outside the B-1 District <br /> The property is a rectangle with a frontage to the highway of 208 feet and a side of <br /> 299 feet. Approximately 70 feet of the rear of the property fall outside of the B-1 <br /> district and in the Al-EX district. The proposed CUP is requested for the entire <br /> property and buildings are proposed in the portion of the property that falls outside <br /> the B-1 district. A rezone would be required for the portion of the property that falls <br /> in the Al-EX district. <br /> In addition,the portion of the property in the Al-EX district is delineated as an <br /> environmental corridor(Conservancy)in the map on page 36 of the Town Plan. On <br /> page 40,the Town Land Use Plan states the following policy: <br /> • "To disapprove development in areas designated as environmental corridors." <br /> Therefore, no development can occur in the portion of the property that falls <br /> outside the B-1 district. <br /> B. Need for public sewer and water- Urban Service Area Town Plan <br /> Policies <br /> The site plan shows a well at its eastern entrance and no septic system. Currently <br /> the property has a holding tank and a well that services the Inn. <br /> The Town Land Use Plan shows the property within the Central Urban Service Area <br /> boundary and states that any significant addition to the urban service area shall have <br /> public sanitary sewage system and public water supply(page 34, 5.b and c). <br /> Additionally,on page 39 the Plan specifies under chapter A. the criteria and process <br /> for changing the Central Urban Areas: <br /> • "To require any division of land within the Central Urban Service Area to be <br /> laid out in a manner that would provide for the efficient construction of <br /> streets,sewer,and possible future water services." <br /> And finally,the plan states the policies for the Development District(Central Urban <br /> Service Area)and on page 46 item 3, it refers to the previous statement of need for <br /> efficient construction of sewer and future water services. <br /> • "All new development must meet the Urban Service Area policies on page 39." <br /> Following the Town Plan Urban Service Area policies and the Town Plan goal: <br /> • "Protect and preserve natural resources in the Town including wetlands, <br /> floodplains, drainage ways, wildlife habitats, and other similar <br /> environmentally significant areas.", <br /> it is clear that a proposal of this magnitude and in this location- surrounded by <br /> wetlands-would be required to be served by public sewer and public water. <br /> C. Part of the Conservancy District/Existing Park& Natural Resource <br /> Lands <br /> The Land Use Plan Map on page 42 shows the entire property in the Conservancy <br /> District(shaded in green).
