COMPOSITE REPORT - CUP No. 1483 <br /> Public Hearing 03/24/98 Town of Westport <br /> a) That the conditional use will not endanger the public health, safety, <br /> and welfare. <br /> b) That uses, values, and enjoyment of other properties in the <br /> neighborhood will not be impaired by the conditional use. <br /> c) That the conditional use will not impede orderly development of <br /> surrounding property. <br /> d) That adequate utilities, access roads, drainage, and other necessary <br /> site improvements will be made. <br /> e) That adequate measures are being taken to provide ingress and egress <br /> to minimize traffic congestion. <br /> f) That the conditional use shall conform to all applicable regulations. <br /> III. SUMMARY <br /> The proposal presents several problems from a policy stand point: <br /> • The portion of the property that falls outside the B-1 district is designated as <br /> environmental corridor where no development can occur <br /> • The development is within the Central Urban Service Area where public <br /> sewer and possible public water are required <br /> • The entire property is in the conservancy district where residential <br /> development is prohibited. <br /> • Two dwelling units would overlap 28 feet into the required setback from the <br /> highway <br /> • No surface parking is provided in the site plan and if it was, no green space <br /> would be available(other than the required set backs) <br /> From a planning perspective,the present use of the property follows the recreational <br /> character and activities that occur in the area as part of the Conservancy District and <br /> Existing Park&Natural Resource Lands. To change it to a multifamily dwelling unit <br /> complex would not only be a problem from a sanitary perspective(no public sewer and <br /> water), but would endanger the Cherokee Marsh which is a unique resource from both <br /> recreational and environmental perspectives. <br />
