Approval of a proper Conditional Use Permit shall be obtained so as to <br /> allow a private school conditioned upon and consistent with this <br /> recommendation. <br /> 9. Review by Town maintenance staff as to the provision of Town services to <br /> be provided to the property and a written report regarding the same to the <br /> Board prior to construction commencing on the property. <br /> 10. The Plan Commission shall have design review approval of the school and <br /> premises, including the architectural design of the building, the private <br /> drive, grading, parking, and landscaping and/or screening for the property, <br /> and shall do so prior to construction commencement. The building design <br /> shall conform substantially to that found at Exhibit E, with a site plan <br /> similar to Exhibit F. <br /> 11. All outstanding special assessments and fees for the parcel, if any, shall be <br /> paid prior to signature of the Development Agreement by the Town. <br /> 12. The Development on the CUP parcel shall be restricted to one building, <br /> containing 5 general classrooms, 4 related specialty rooms, a library room, <br /> a multi-purpose room, and other necessary and related service rooms, and <br /> related construction as shown at Exhibit E, and only by Petitioner, unless <br /> assignment is permitted by the Town. No further construction shall be <br /> allowed or permitted on the parcel until approval has been received for <br /> further improvements by the Town, nor shall any other use be allowed on <br /> the property. As part of the Development Agreement or as a separate <br /> document, the Town and the Petitioner shall enter into the standard <br /> restriction agreement previously utilized by the Town in similar situations <br /> to restrict the development of the parcel for use as a private school by the <br /> Petitioner as represented to the Town and described herein. The agreement <br /> shall be in a form acceptable to the Town attorney. <br /> 13. The applicable fire and EMS departments serving the property shall review <br /> the plans for the structure and the site, shall be asked to provide a written <br /> report on providing services to the property and the structure, and the <br /> Petitioner shall comply with such recommendations to the satisfaction of <br /> those public safety service providers. <br /> I:1WW.800011471CUPREC.Tt3W <br /> 1414971729 6 <br />
