CUP No. 1415 was previously denied by the <br /> Zoning & Natural Resources Committee (hereafter "ZNR") on June 3, <br /> 1997 by a vote of 4 - 3 . That denial was appealed to the Dane <br /> County Board of Supervisors . Although a majority of the Board of <br /> Supervisors voted to approve CUP No. 1415, the denial by ZNR was <br /> sustained because the vote in favor did not constitute a three- <br /> quarters majority as required by § 10 .255 (2) (j ) of the Dane <br /> County Code of Ordinances . <br /> Section 10 .255 (2) (k) of the Dane County Code of Ordinances <br /> governs the resubmission of an application for a conditional use <br /> permit . That section provides as follows : <br /> Effect of denial of application. No application <br /> for a conditional use which has been denied wholly or <br /> in part by the zoning committee shall be resubmitted <br /> for a period of one year from the date of said denial, <br /> except on the grounds of new evidence or proof of <br /> change of conditions found to be valid by the zoning <br /> committee. <br /> (emphasis added) <br /> This resubmission is based on new evidence and a change in <br /> the conditions of the application which clearly warrant its <br />
