MAR 23 '98 03:12PM TOWN OF WESTPORT P.8/21 <br /> 1. A Development Agreement between the Town and Developer, in a form <br /> acceptable to the Town Attorney, shall be executed requiring the Petitioner <br /> to pay Town Engineer and Town Attorney review fees. Part of this <br /> agreement shall include provisions to prevent annexation of the parcel, and <br /> to provide that if all or part of Petitioner's property should be tax exempt, <br /> fees for Town and County services provided to the parcel shall be paid, the <br /> latter provision to be in a form similar to that entered into by the owners of <br /> the Westshire development in the Town. Fees for any and all reviews are <br /> to be paid to the Town prior to the commencement of any construction on <br /> the site. <br /> 2. Documentation from the Town Engineer stating that road, sewer, water <br /> stormwater detention/retention, and other required public improvements, <br /> have met Town standards. Onken Road improvement shall be as discussed <br /> at the various Town meetings, including acceptable Onken Road and CTH's <br /> M and Q intersection improvements, which may include <br /> acceleration/deceleration and turning lanes, Onken Road improvements, <br /> including potential widening and/or turning lanes at the School driveway, <br /> and future necessary improvements because of development phasing. <br /> 3. Contracts entered into by the Town and Petitioner for all public <br /> improvements shall be reviewed and approved by the Town Attorney and <br /> Town Engineer. <br /> 4. Erosion control and stormwater drainage and runoff plans shall be approved <br /> by the Town Engineer and the Town Board, prior to construction <br /> commencing on the CUP property. <br /> 5. A letter of credit for contemplated road, sewer, water, stormwater <br /> detention/retention, and other required public improvements shall be <br /> required in amounts approved by the Town Engineer and in a form <br /> approved by the Town Attorney, <br /> 6. The Petitioner shall comply with any rules, regulations, and permits of <br /> County, State or Federal agencies with respect to its septic system, wells, <br /> erosion control, stormwater drainage control, and construction erosion and <br /> drainage control measures, as well as all applicable provisions of Town <br /> Ordinances. <br /> 7.
