PETITION TO REZONE LAND # -7 / <br /> 7 Q <br /> SAM J. JACOBSEN, c/o Madison Country Day School <br /> Purpose of Rezone Petition <br /> The above petition seeks to rezone approximately 49 acres in <br /> the town of Westport, presently zoned A1 (Exclusive) , into three <br /> separately zoned parcels as follows : <br /> (a) _17.68- acres -- A2 <br /> (b) 29 .25 acres -- RE-1 <br /> (c) _ 3 acres -- CO <br /> (See Rezoning Descriptions Two, Three and Four) <br /> This petition has been submitted with a related application <br /> for conditional use permit allowing for the construction of a <br /> private school on a portion of the land sought to be rezoned as <br /> A2 . (The portion of the A2 land subject to the CUP application <br /> is described on Rezoning Description One) . The RE-1 and CO <br /> rezone requests will have a delayed effective date contingent <br /> upon the approval of the CUP application. The purpose for the <br /> delayed effective date is to ensure that the relevant land <br /> remains usable for agricultural purposes in the event the CUP <br /> application is not obtained. <br /> The purposes for each of the rezone requests are straight- <br /> forward and relate to the operation of the Madison Country Day <br /> School on the property. The RE-1 rezone will allow the School to <br /> use that potion of the property for recreation purposes while, <br /> at the same, and consistent with the School's intention of <br /> leaving that portion as open green space, restricting it to such <br /> purposes. The change from A1 (Exclusive) to A2 is requested <br /> solely because that portion of the land will have insufficient <br /> acreage (17.68 acres) to sustain A1 (Exclusive) once the adjacent <br /> 29.25 acres is rezoned RE-1. Finally, the CO rezone will create <br /> a permanent oak grove conservancy along one side of the School <br /> site to serve the educational needs of the School, in addition to <br /> the common welfare. <br /> The schedule for development of the School site is <br /> contingent upon the approval of the CUP application. The School <br /> intends to begin development at the earliest possible date after <br /> such approval is obtained. <br /> This petition, and the accompanying CUP application, relate <br /> to a prior Conditional Use Permit application (#1415) submitted <br /> by the above applicant . The materials submitted previously in <br /> connection with that application (site plans, impact studies, <br /> government approvals, and the like) are hereby incorporated into <br /> this petition. <br /> e:\xf\client\63580\0001\emn0551.w521 2/3/98 <br />
