COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 7171. This proposed implement dealer rezoning raises some policy concerns related to <br /> the town/county plan in the Town of Rutland. <br /> The site is currently undeveloped farmland with a golf driving range on the west, a corn drying <br /> and storage business to the north(A-B parcel) and undeveloped agricultural land to the north, <br /> east and south. <br /> The relevant policy for this area is: <br /> "To consider agricultural related commercial uses only:If a rural location is <br /> required to serve farmers, and if it must be in proximity to a resource; if no prime <br /> agricultural land is used; and if wastewater can be adequately handled by a soil <br /> absorption system. <br /> Comment:Many such uses would be zoned A-B Agribusiness; however, some <br /> require other commercial zoning. In these cases, specific conditions on the <br /> rezoning will be required to limit the use allowed. <br /> Staff comments related to policy: <br /> • An implement dealer is typically an agriculture related commercial use; however this <br /> application includes contractors' equipment. The request is for C-2 Commercial zoning to <br /> accommodate the contractors' equipment and thus there is a policy consistency question. <br /> • This is a rural location; however, it is right outside the Oregon urban service area. <br /> • The application notes that the site is 100% cropland and 90% Class I& II soils in terms of <br /> productivity. Most of the site is prime farmland by USDA definition. <br /> • Wastewater is not necessarily a problem at this type use. <br /> • The other location concern is the emerging commercial strip development along STH 138. <br /> There needs to be coordination with the Village of Oregon and highway officials <br /> concerning the type of development and highway capacity impacts in this area. <br /> • These policy concerns need to be addressed prior to any approval of the rezoning. <br /> • The C-2 Commercial zoning permits many uses which would be incompatible at this <br /> location; therefore, there would need to be a condition on the rezoning to limit the use to <br /> those requested. As a matter of compromise and policy consistency, there may need to be <br /> a limit on the balance between agricultural equipment and contractors' equipment on-site. <br />
