• , <br /> 2-3-98 <br /> I would like to amend a deed restriction that covers my land. The restriction I would like to <br /> amend is: "The driveway shall be located at the edge of the field and not through the field" <br /> (Dane county Ordinance Amendment No. 6025). I would like this amendment taken out because <br /> I have a driveway that could be construed as being in violation of the deed restriction. <br /> In May of 1996 I went to get a building permit. At that time I was told that the rezone of my land <br /> was null and void because I did not file the deed restrictions. I was then told I could rezone via <br /> the fast track rezone rules. I did that and I received a building and driveway permits. We then <br /> decided we would not build but would buy an existing home. I consequently let the building <br /> permit lapse. I recently sold my home and we decided to build. I told the driveway builders to go <br /> ahead with the driveway where they, I and the Dane county Highway Dept. employee decided <br /> was the best place. On 1-29-98, I went to Dane Co. Zoning to get my building permit reissued <br /> and they told me it had lapsed. They said I had to either go through the rezoning process or use <br /> fast track rezoning. The requirements for fast track rezoning had changed since last year. <br /> The zoning clerk looked at the records and saw that I had in fact filed the original deed <br /> restrictions and the zoning that I had originally applied for was good. The problem is I already <br /> told the driveway builder to start the driveway and I have a deed restriction that could cause some <br /> problems.
