Burgess, co-applicant <br /> Bruce Kaufman, attorney <br /> CORRECTION: <br /> In my original staff report for Petition# 7183, I indicated that rezoning Lot 2 to RH-2 would <br /> effectively remove a deed restriction prohibiting residential use on that portion of the property. <br /> This restriction appeared to have been imposed as part of a previous rezoning approval (petition <br /> # 6658). I based that determination on the legal description for the deed restriction, which <br /> seemed to indicate that three parcels were to be restricted. <br /> Upon review of the ZNR Committee minutes for the approval of Petition#6658 (copy attached), <br /> the Zoning Administrator and I now agree that interpretation was in error, and that only two <br /> parcels were restricted. This means that the area identified as Lot 2 on CSM 8479 was not deed <br /> restricted and should be considered a buildable lot. This means that(assuming the balance of the <br /> property is either deed restricted or rezoned to CO-1) Petition# 7183 will not increase the <br /> residential density beyond what has already been approved. <br /> The balance of my staff report stands as written.
