000003 <br /> The undersigned owners of Parcel A and B described on the <br /> the attached Exhibit, declare the following covenants and <br /> restrictions for said parcels. <br /> (1) No residence shall be constructed on either parcel and the <br /> Lots cannot be further subdivided. Exchange of land between <br /> adjacent landowners is allowed provided no additional lots <br /> are created and further provided that the restored prairie <br /> is not disturbed. <br /> (2) No boats, campers, trailers, commercial or recreational <br /> vehicles may be parked or stored on either conservancy <br /> Parcel; except that any owner or permanent resident of <br /> either Parcel (but not guests unless accompanied by an owner <br /> or resident) may use a golf cart, garden tractor or similar <br /> vehicle for maintenance or enjoyment of the prairie. <br /> (3) No outbuildings, fences or other structures may be <br /> constructed unless deemed necessary for the maintenance of <br /> the conservancy, as agreed by all owners; existing fencing <br /> is permitted. <br /> (4) No fires (except for prairie maintenance) or overnight <br /> camping shall be permitted. No public access shall be <br /> permitted across either parcel, but up to twelve persons <br /> shall be permitted on the prairie when accompanied by an <br /> owner or permanent resident who will be held accountable for <br /> the conduct of that owner's guests while on the lands <br /> subject to this agreement. Notwithstanding this <br /> restriction, the owners may agree to allow larger gatherings <br /> for educational, charitable or other purposes. <br /> (5) No domestic pets/animals shall be allowed on the restored <br /> prairie nor shall any animal be penned or housed within 100 <br /> feet of the conservancy area. . <br /> (6) The parties agree that the lands which are subject to these <br /> covenants and restrictions shall be restored to native <br /> prairie subject to their mutual participation and <br /> contribution as further described in the following <br /> paragraphs. <br /> A For the calendar years 1998 and 1999, Neil Diboll, <br /> President of Prairie Nursery shall be employed to <br /> design and supervise the installation of the prairie in <br /> a manner similar to that of the restored prairie on <br /> adjoining land and he shall continue as the consultant <br /> from year-to-year with the consent of all of the <br /> owners. In the event that the parties cannot agree on <br /> the appropriate measures to be taken for the <br /> maintenance of the prairie, the consultant shall make <br /> such decision which shall be binding on the owners and <br /> if there is no consultant then employed by the owners, <br /> Neil Diboll or his successor shall be asked to decide <br /> on the proper maintenance for that year.
