4. Madison Gas & Electric shall provide the Town of Middleton with a copy of all complaints <br /> regarding the facility and the Utility's response; <br /> 5. The approval for the placement of the generators on the site shall expire on January 1, 2000 <br /> unless extended by the Town of Middleton; <br /> 6. Madison Gas & Electric shall place with the Town of Middleton an irrevocable letter of <br /> credit in the amount of$100,000 to guarantee compliance with the conditions set forth in this <br /> approval. <br /> MG&E has indicated that these conditions are acceptable, except that they would prefer to issue <br /> a performance bond for$100,000 instead of a letter of credit. <br /> VII. SITE AND NEIGHBORHOOD PLANNING ISSUES <br /> The site is well-screened from view, and should have little visual impact on surrounding <br /> properties. As noted in the RPC staff comments and in the Town of Middleton's conditions,the <br /> primary potential impact from the proposed generators would appear to be from noise. The <br /> conditions recommended by the Town of Middleton would appear to adequately address these <br /> concerns, and the proposed use seems reasonably compatible with surrounding uses. However, <br /> as noted above, C-2 zoning could allow a number of uses that could create potential nuisances or <br /> hazards to nearby residences to the east. <br /> VIII. ADDITIONAL COUNTY APPROVALS REQUIRED <br /> County zoning permits will be necessary before the generators could be installed. No other <br /> county approvals are required. <br /> IX. FINDINGS AND CONCLUSIONS <br /> The petition is arguably consistent with the town land use plan, and the requested zoning is <br /> consistent with that of surrounding properties. Properly conditioned,the proposed use should <br /> not have a major impact on nearby residential use. Although the site's proximity to wetlands and <br /> drainageways and the permeability of local soils could pose a potential risk of ground or surface <br /> water contamination, such risks could be mitigated with reasonable precautions. <br /> The Committee should consider adopting the conditions requested by the Town and adding two <br /> additional conditions: <br /> 1. The permitted uses on the site be limited to utility services, auxiliary or supplemental electric <br /> generating stations, warehousing and storage incidental to a permitted use, and storage or <br /> processing of waste materials normally associated with electric generation facilities. <br /> 2. That any storage of hazardous or toxic materials take place in a roofed structure, and that all <br /> hazardous materials be contained so that any spills, leaks or runoff do not enter any ground <br /> or surface waters. The landowner shall adopt a spill management plan that meets all current <br /> commonly accepted management practices to prevent a hazard to air, water, natural resources <br /> or public safety. <br />
